Terms and Conditions for 9Yaps

Welcome to 9Yaps. 9Yaps is a discount app and website for Tampa Bay locals, owned and operated by 9yaps LLC ("we," "our," or "us"). These Terms and Conditions ("Terms") are the agreement between you and us for using the 9Yaps mobile app (iOS and Android) and the website at 9yaps.com (together, the "Service"). By creating an account, using the app as a guest, or using the website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who Can Use 9Yaps

You must be at least 13 years old to use 9Yaps. If you are under 18, you confirm that a parent or guardian is okay with you using it. 9Yaps is built for locals in the Tampa Bay area, but we may offer it to others. We may ask you for your school or university, and you agree that what you tell us is accurate. Some deals may be limited to students or to certain schools.

2. Your Account

You can use some parts of 9Yaps as a guest, but some features need an account. You can sign up with an email and password, or with Google or Apple.

• Keep your login private. You are responsible for everything that happens under your account.

• Tell us right away at management@9yaps.com if you think someone else is using your account.

• Give us accurate information, and keep one account per person.

• You can delete your account at any time from inside the app, or by emailing management@9yaps.com.

3. How Deals Work

9Yaps connects locals with discounts offered by local businesses ("Partner Businesses"). Please understand the following:

• Deals are offered by the Partner Businesses, not by us. We do not sell the food, drinks, or services, and the Partner Business is responsible for them.

• Each deal has its own rules, such as how often you can use it, which days or hours it applies, whether it is dine-in only, and how to show it. Read the deal before you redeem it.

• Deals can change, expire, or be removed at any time, including by the business or by us. A business's hours, menu, and deals may also be out of date in the app. We try to keep information accurate but do not guarantee it.

• A Partner Business may refuse a deal if it believes the rules were not followed, or in rare cases for reasons of its own. We are not responsible if a business refuses, runs out of an item, or makes a mistake.

• Redeeming a deal normally means showing the redeem screen in the app to the staff member. Do it honestly and only when you are actually at the business and ready to use the deal.

• Any purchase you make at a business is a transaction between you and that business. 9Yaps is not a party to it. Any problems with food, service, allergens, or safety are between you and the business. If you have a food allergy or dietary need, please ask the business directly.

4. Points, Streaks, Rewards, and Referrals

9Yaps may give you points, streaks, rewards, and referral bonuses for using the app.

• Points and rewards have no cash value. They cannot be sold, traded, transferred, or exchanged for money.

• We may change, pause, or end the points and rewards programs, or change how they work, at any time. We may adjust or remove points that were earned by mistake, abuse, or breaking these Terms.

• Referral codes are for sharing 9Yaps with real friends. You may not use your own code, create fake accounts, or use bots, lists of codes, or other tricks to earn referral bonuses.

• Rewards are subject to availability and to the rules shown when you claim them.

5. Giveaways and Promotions

From time to time we may run giveaways, contests, or special promotions. Each one may have its own official rules, including who can enter and how winners are chosen. Where official rules exist, they apply together with these Terms, and if they conflict, the official rules win for that promotion. No purchase is necessary to enter a 9Yaps giveaway unless the rules say otherwise, and a giveaway is void where prohibited. We may disqualify anyone who cheats or breaks the rules.

6. Acceptable Use

When using 9Yaps, you agree not to:

• Redeem deals dishonestly, such as redeeming without being at the business, using screenshots or recordings of a redeem screen, or sharing or selling your account or redeems.

• Create fake or duplicate accounts, or use someone else's account.

• Use bots, scripts, or other automation, or collect data from the Service by scraping.

• Hack, probe, overload, or disrupt the Service, or try to get around its security or limits.

• Copy, reverse engineer, or attempt to get the source code of the app, except where the law allows it.

• Upload anything unlawful, offensive, or that infringes someone else's rights (for example, a profile photo that is not yours to use).

• Harass or mislead people at Partner Businesses or other users, or use 9Yaps for any unlawful purpose.

7. Notifications and Location

If you allow them, we send push notifications about deals and updates. You can turn notifications off at any time in your phone settings. If you allow location access, we use it as described in our Privacy Policy. You can turn location off in your phone settings, though some features, like nearby deals and the map, will be limited.

8. Our Ownership and Your Content

The 9Yaps name, logo, app, website, and everything in them (other than the content of Partner Businesses and our users) belong to us or our licensors and are protected by law. We give you a limited, personal, non-exclusive, non-transferable permission to use the Service for your own use according to these Terms. Business names, logos, photos, and menus belong to those businesses.

If you give us content, such as a profile photo or a message to us, you keep your rights to it, and you give us permission to use it as needed to run and improve the Service. You promise you have the right to share it.

9. Third-Party Services and Links

9Yaps uses third-party services, such as Google (sign-in and Maps), Apple (sign-in), and Firebase, and may link to businesses' websites, menus, and social media. We do not control those, and their own terms and privacy policies apply. We are not responsible for them.

10. Disclaimer

9Yaps is provided "as is" and "as available." To the fullest extent the law allows, we make no promises (express or implied) that the Service will always be available, error-free, secure, or accurate, or that any deal, price, hours, or business information will be correct or available. Some places do not allow certain disclaimers, so some of this may not apply to you.

11. Limit of Liability

To the fullest extent the law allows, 9yaps LLC and its owners, employees, and partners are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Service, including anything related to a Partner Business's products, services, food, allergens, or conduct. Our total liability for any claim relating to the Service is limited to $100. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to cover us from claims, losses, and costs (including reasonable legal fees) that come from your misuse of the Service or your breach of these Terms, to the extent the law allows.

13. Suspension and Termination

We may suspend, restrict, or end your access to 9Yaps at any time, with or without notice, especially if we believe you broke these Terms or abused deals, points, or referrals. You may stop using 9Yaps and delete your account at any time. Sections that by their nature should continue (such as ownership, disclaimers, limits of liability, and the legal terms below) will remain in effect after your account ends.

14. Changes to the Service or These Terms

We may change, add, or remove features of 9Yaps at any time. We may also update these Terms from time to time. Changes will be posted on this page and the "Last Updated" date will change. If we make a significant change, we will also notify you in the app or by email. If you keep using 9Yaps after changes take effect, you agree to the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute that we cannot resolve informally will be brought in the state or federal courts located in Pinellas County, Florida, and you and we consent to those courts. Before filing anything, please contact us first at management@9yaps.com so we can try to fix it.

16. Apple and Google

If you downloaded 9Yaps from the Apple App Store or Google Play, you acknowledge that these Terms are between you and 9yaps LLC, not Apple or Google. Apple and Google have no obligation to provide support or maintenance for the app and are not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS app.

17. General

If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a part right away, we have not given it up. You may not transfer your rights under these Terms to anyone else; we may transfer ours as part of a sale or reorganization of our business. These Terms and our Privacy Policy are the whole agreement between you and us about the Service.
